Terms and Conditions

These Terms and Conditions apply to all photography sessions, bookings, image sales, and product purchases provided by Brittany Jones trading as Fitztography (“Fitztography”, “Photographer”, “I”, “me”, or “my”). By booking a photography session, the Client (“you” or “your”) agrees to these Terms and Conditions. Event photos & use of the website are covered by the Fitztography Terms of Sale & Digital License shown at checkout.
These Terms and Conditions apply to both paid and complimentary sessions, including promotional, portfolio-building, project-based, and special initiative sessions, unless otherwise agreed in writing.
1. Booking and Session Credit
A non-refundable session fee is required to secure and reserve your photography session.
The full amount of the session fee is converted into credit that may be used towards the purchase of photographs and/or products from that session. The session fee is therefore not an additional charge on top of the Client’s image or product purchase.
The session credit:
- may only be used towards photographs and/or products purchased from the applicable session;
- cannot be exchanged for cash or refunded, in whole or in part;
- is not transferable to another person or session; and
- cannot be used towards travel fees, additional services, or purchases unrelated to the applicable session unless otherwise agreed in writing
Any amount purchased above the available session credit is payable by the Client.
If a Client needs to reschedule, they may do so once provided that at least 48 hours’ notice is given. The replacement session must take place within three months of the original session date, subject to Photographer availability. The Photographer may allow the Client to reschedule multiple times at their discretion
2. Session Conduct and Animal Welfare
The Client is responsible for the safety, control, and behaviour of their pet(s) throughout the session.
Pet/s must be safely restrained using an appropriate collar, harness, or lead unless the Photographer specifically directs otherwise. The Client remains responsible for their pet(s) at all times, including when the pet is off-lead.
The Client must disclose any relevant behavioural, medical, or safety concerns before the session, including any known history of aggression towards people or other animals.
Based on information provided by the Client, the Photographer may recommend an alternative location that is more suitable for the pet’s safety and wellbeing. The Photographer may decline to photograph at a Client’s preferred location if they reasonably consider the location unsuitable or unsafe.
The Photographer reserves the right to end a session immediately if a pet’s behaviour creates a safety risk, presents a risk to other people or animals, or makes it unreasonable to continue. If the session is ended for these reasons, the session fee and associated session credit will not be refunded.
Dogs in Heat
If a dog is in heat, the Client must notify the Photographer as soon as reasonably possible before the session.
Because many sessions take place in outdoor locations where other dogs may be present, the session may be rescheduled without penalty. If the Client chooses to proceed on the original date, the Photographer may instead conduct the session at the Client’s property. The Client acknowledges that this may affect the appearance, variety, and overall style of the resulting photographs.
Animal Welfare
Fitztography is committed to the welfare and humane treatment of animals.
The Photographer will not proceed with, and may immediately terminate, a session where there is reasonable concern that an animal is being mistreated, neglected, or otherwise subjected to unacceptable welfare practices.
The Photographer reserves the right to refuse or discontinue services where there are reasonable grounds to believe that an animal is being subjected to cruelty, neglect, or unethical treatment. In such circumstances, the session fee and associated session credit will be forfeited and no further services will be provided.
3. Image Selection, Editing and Delivery
Following the photography session, the Photographer will select and prepare a gallery of lightly edited images (the "proof gallery". The size of this gallery, which images are selected, and how they are edited are up to the Photographer's discretion.
Photos purchased following the delivery of the proof gallery, either as digital files or for printing, will be fully edited. Standard editing and retouching may include exposure and colour correction, cropping, removal of collars and leads, and removal of minor distracting elements. The Photographer will allow the Client to preview the final edited image before the print of any physical artwork - the Client may request slight alterations, but the Photographer reserves the right to decline further alterations
More complex retouching, extensive object removal, or specific artistic alterations requested by the Client may incur an additional fee.
The Photographer does not provide RAW, unedited, or rejected images under any circumstances.
4. Photographic Products and Digital Images
Photographic products are custom-made and/or ordered specifically for the Client. Accordingly, all product sales are final and non-refundable, except where required by law or where a product is defective.
The Client is responsible for checking products upon receipt and notifying the Photographer of any defect or issue within seven (7) days.
The Photographer is not responsible for the quality, colour accuracy, cropping, or other characteristics of prints or products produced by third parties from digital files supplied to the Client.
Digital Images
Digital images supplied by Fitztography are licensed to the Client for personal, non-commercial use only, unless a separate commercial licence has been agreed in writing.
The Client may not use purchased digital images for commercial, advertising, promotional, business, or other commercial purposes without written permission from Fitztography.
Purchased digital images must not be materially edited, filtered, altered, manipulated, or otherwise modified without written permission from the Photographer. Basic cropping and resizing for personal display is permitted.
The Client must not remove copyright information or watermarks where present.
Commercial licensing may be available upon request and will be subject to separate terms and fees.
Session Credit
Where a session includes a specified amount of photography credit, that credit may be applied only to eligible photographs and products from that session.
Credit has no cash value, cannot be transferred, and cannot be exchanged for a refund.
6. Payment and Payment Plans
Any amount owing after the application of the Client’s session credit must be paid before digital images are delivered unless an alternative payment arrangement has been agreed in advance. Physical products will not be ordered until the required payment has been received, unless otherwise agreed in writing.
Payment plans may be offered at the Photographer’s discretion and must be agreed upon before products are ordered.
Where a payment plan is in place, delays or missed payments may result in the corresponding delay to ordering and delivery. The Photographer reserves the right to charge reasonable fees for overdue payments where permitted by law.
7. Copyright and Ownership of Photographs
Brittany Jones trading as Fitztography is the author and copyright owner of all photographs created by the Photographer, including photographs commissioned by the Client.
The parties expressly agree that, notwithstanding any default rule concerning commissioned photographs under section 21 of the Copyright Act 1994, copyright in photographs created by Fitztography shall remain with Brittany Jones trading as Fitztography and shall not pass to the Client by virtue of the Client commissioning, paying for, or purchasing photographs.
This clause constitutes an agreement to the contrary for the purposes of section 21(4) of the Copyright Act 1994.
The purchase of a photograph, digital file, print, or other photographic product does not constitute a transfer or assignment of copyright.
The Client receives only the personal-use licence expressly granted under these Terms and Conditions or any separate written licence agreed with Fitztography.
All rights not expressly granted to the Client are reserved by the Photographer.
Nothing in these Terms and Conditions transfers ownership of the Photographer’s copyright unless the Photographer expressly agrees to a separate written copyright assignment.
8. Image Storage and Archiving
Purchased final images will ordinarily be retained and archived by the Photographer for a period of twelve (12) months from the date of ordering.
After this period, Fitztography does not guarantee that photographs will remain available for reordering or replacement.
The Client is responsible for downloading and safely backing up digital files supplied to them.
Retrieval of archived photographs may be subject to an administration or retrieval fee.
9. Cancellations, Rescheduling and Reshoots
Sessions may be rescheduled by the Photographer due to severe weather, illness, equipment failure, or other circumstances that make the session impractical or unsafe.
Where reasonably possible, an alternative date will be offered.
If the Client fails to attend a scheduled session, cancels without the required notice, or otherwise prevents the session from proceeding, the session fee and associated session credit may be forfeited.
A reshoot is not automatically provided where the Client is dissatisfied with the photographs due to subjective factors such as weather, lighting, the dog’s behaviour, the pet not performing as expected, or personal preferences regarding the resulting images.
Where a session is materially disrupted by circumstances outside the reasonable control of both parties, such as significant equipment failure, the Photographer may offer a reshoot at their discretion.
10. Liability and Safety
The Client remains responsible for their own safety and for the safety, behaviour, and control of their pet(s) throughout the session.
To the extent permitted by law, Fitztography is not responsible for injury, illness, allergic reactions, loss, damage, or other harm arising during or after a photography session, except where such liability cannot lawfully be excluded or limited.
The Photographer will not conduct sessions at water locations where they reasonably believe there is a risk from toxic algae or other known environmental hazards.
For sessions conducted near water, the Client remains responsible for supervising their pet(s) and accepts responsibility for risks associated with their pet entering or coming into contact with the water.
The Client is responsible for informing the Photographer of any relevant risks, medical conditions, behavioural concerns, or other circumstances that may affect the safety of the session.
11. Privacy and Personal Information
Fitztography collects and uses Client information for purposes including booking and managing photography sessions, communicating with Clients, processing orders and payments, delivering products, maintaining business records, and, where permitted, sending marketing communications.
Personal information will not be sold to third parties.
Information may be shared with relevant service providers where reasonably necessary to provide the services requested by the Client, such as professional print laboratories, album suppliers, payment providers, or delivery services.
Clients may opt out of marketing communications at any time.
12. Artistic Style and Creative Control
The Client acknowledges that Fitztography is a professional pet photography business and that the resulting photographs will reflect the Photographer’s individual artistic style, creative judgement, editing approach, and interpretation.
The Photographer retains creative control over photographic composition, posing, lighting, image selection, editing, cropping, and artistic presentation.
The Photographer does not guarantee that a particular pose, expression, behaviour, background, weather condition, or photographic result will be achieved.
No refund will be provided solely because the Client’s subjective expectations differ from the Photographer’s artistic style or creative decisions.
13. Use of Images for Portfolio and Marketing
Unless the Client has expressly opted out in writing, Fitztography may use photographs from the Client’s session for portfolio, website, social media, advertising, promotional material, educational material, photography competitions, awards, publications, and other legitimate business or promotional purposes.
Where reasonably requested, the Photographer may avoid publishing the Client’s name, address, or other identifying information alongside the photographs.
An opt-out request must be made in writing and should be made before the session wherever possible. An opt-out does not require the Photographer to remove images that have already been lawfully published or submitted to competitions, awards, publications, or other third-party platforms before the opt-out was received.
14. Force Majeure
The Photographer will not be responsible for failing to perform services where circumstances beyond the Photographer’s reasonable control prevent the session or associated services from proceeding.
Such circumstances may include extreme weather, natural disasters, pandemics, government restrictions, serious illness, emergencies, or other events outside the Photographer’s reasonable control.
Where practical, the session will be rescheduled.
15. Travel and Location Fees
Photography sessions outside the Photographer’s standard service area may incur a travel fee.
Any applicable travel fees will be communicated to the Client before booking.
The Client is responsible for any permits, entry fees, parking charges, venue fees, or other costs required to access a requested location unless otherwise agreed in writing.
16. Client Responsibility for Wall Art Installation
Once wall art or other photographic products have been delivered, the Client is responsible for ensuring that they are installed safely and appropriately. Fitztography does not provide installation services.
To the extent permitted by law, the Photographer is not responsible for damage to property, injury, or damage to artwork arising from incorrect or unsafe installation after delivery.
17. Changes to These Terms
Fitztography reserves the right to update these Terms and Conditions from time to time.
The Terms and Conditions that apply to a Client’s booking are those provided to and agreed by the Client at the time of booking, unless a subsequent written agreement between the Client and Photographer expressly replaces or varies them.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
